Benefito User Agreement

Welcome to the user agreement (the "Agreement" or "User Agreement") for Benefito.com. Please read these terms carefully before using this site. If you do not agree to be bound by these terms, please do not access the site or use the services provided by Benefito.com.

LIMITATION OF LIABILITY:

1. Benefito Inc., its managers, owners, or employees will NOT be liable for any harms, including direct, indirect, incidental, special, consequential or exemplary damages, including but limited to, damages from loss of profits, goodwill, use, data or other intangible losses or damages of any kind arising out of or relating to the use of services indicated in the site.
2. Benefito.com does not warrant that this site, its services, or email sent from Benefito.com are free of harmful components such as viruses. In no event shall Benefito.com be liable for damages of any kind relating to the use of this site, including, but not limited to direct, indirect, incidental, and consequential damages, and damages for loss or corruption of data or programs, service interruptions and procurement of substitute services. UNDER NO CIRCUMSTANCES WILL BENEFITO'S AGGREGATE LIABILITY, ON ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT, EXCEED THE PRICE PAID BY YOU FOR YOUR ACCOUNT.
3. While all service providers are strongly encouraged to provide background check reports to the clients, Benefito Inc. makes no representations or warranties as to the conduct of such individuals or their compatibility with any current or future clients. For the safety of its users, Benefito strongly encourages its users to use third party escrow services to provide additional user verification. In no event shall Benefito be liable for any damages whatsoever arising out of or relating to the conduct of you or anyone else in connection with the use of the services provided by Benefito.com, including, but not limited to, physical injury, emotional distress, and/or other damages resulting from communications, meetings, providing or receiving services to and from other users.
4. Benefito.com does not control the information provided by registered users and other users that is made available through our website. Please use caution, common sense, and judgment when using the Site. By using this Site, you agree to accept such risks and Benefito.com is not responsible for the acts or omissions of users on the Site.
5. Benefito Inc., its affiliates, managers, owners, agents, and employees, will be held harmless from any claims including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
6. Benefito provides an online service market to connect service providers including individuals, home based businesses, and small businesses to clients. Under no circumstance will agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship be intended or created by this Agreement. Benefito is NOT responsible for the service providers' conduct or service quality.
7. Benefito Inc. does not control the content of any user's profile and does not have any obligation to monitor such content for any purpose. All content provided by a user of this site is the sole responsibility of that user, not Benefito Inc.
8. Benefito Inc. does not control the content of the Benefito Blog, articles, and Discussion Forums and does not have any obligation to monitor such content for any purpose. Benefito.com assumes no responsibility for any consequence relating directly or indirectly to any action or inaction you take based on the contents,  information, services or other material on this site.
9. The links, contents, and sites displayed on Benefito plow are posted by Benefito users over whom Benefito exercises no control. Benefito Inc. cannot and does not screen the sites. Benefito disclaims any responsibility for any harm resulting from using or accessing any information or services on these sites through benefito.com.

OUR SERVICES:

1. Membership Eligibility: MINORS MAY NOT USE THE SERVICE PROVIDED BY BENEFITO. By posting, you represent and warrant that you are at least 18 years old and can form legally binding contracts under applicable law. For persons under 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians.
2. Exclusive Use: Your account is for your sole, personal use, you may not authorize others to use your account, and you may not assign or otherwise transfer your account to any other person or entity.
3. All registered users are solely responsible for the content or information you publish, display or otherwise communicate in any manner (hereinafter, "post") on the Service, or transmit to other Users.
4. Registered Users will not post on the Service, or transmit to other Users via emails, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights.
5. Registered Users will not provide inaccurate, misleading or false information to Benefito.com or to any other Users.
6. Users will not engage in advertising to, or solicitation of, other Users to buy or sell any products or services through the Service. Users will not transmit any chain letters or junk E-mail to other Users.
7. Users will not post, copy, modify, transmit, show in public or private, create any derivative works from, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
8. All users are solely responsible for his or her interactions with other Users. You agree to take normal precautions when meeting individuals through the Service. In addition, you agree to review and follow the recommendations set forth in Benefito’s Safety Tips which is provided on the website.
9. You understand that the Company makes no guarantees, either express or implied, regarding your employment and income, or finding the right service providers or clients.
10. You will promptly report to the Benefito any violation of the Terms of this Agreement by other users via the feedback. Benefito.com reserves the right, but has no obligation, to monitor the materials posted in the public areas of the Service. Benefito shall have the right to remove any material that in its sole opinion, violates, or is alleged to violate, any applicable law or either the letter or spirit of this Agreement.
11. All users are solely responsible for the content of the information they post in the public areas on our site. Connecting emails sent between the clients and the service providers that are not readily accessible to the general public will be treated as private by Benefito to the extent permitted by applicable laws.
12. Benefito reserves the right, in its sole opinion, to modify or delete postings by users that are considered to be inappropriate, invalid, or unsuitable to the company's services and the Benefito online community.

USER CONDUCT

Unacceptable actions, conditions and content on this site, listed below, will constitute grounds for blocking your access to this site, removal of posted material and cancellation of your registration and or membership. As condition of your use of this site and Benefito's service, you agree that you shall not:

1. Upload or post any information or advertisement that may be considered as competitive to the Benefito service. Solicitation for services by any means, other than those offered or directly approved by Benefito, to its registered users or Members is strictly forbidden. And under no circumstances shall the harvesting and commercial re-use of emails be allowed
2. Share your membership or contact information with any other person or disclose your password to any third parties or share it with any third parties. If, despite the foregoing, you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf.
3. Upload, post, email or otherwise transmit any content that is unlawful, harmful, threatening, harassing, defamatory, obscene, vulgar, invasive of another's privacy, hateful, discriminatory or otherwise objectionable.
4. Exhibit expressions of abuse, offensive language and imagery, obscenity, or pornography, including, but not limited to, child abuse, child pornography, depictions of minors engaged in sexual conduct or explicitly sexual situations, or any other material that could give rise to any civil or criminal liability under applicable state or federal law, or violating any laws or regulations of any governing body having jurisdiction over Benefito or its subsidiaries, affiliates or use.
5. Harm minors in any way.
6. All users are solely responsible for the reporting of their income taxes. Should an employer and employee relationship occurred between the clients/customers and the service providers, the withholding of employee's income taxes are to be reported according to applicable laws and regulations.
7. The opinions expressed by article authors to benefito.com are their own. Benefito bears no responsibility for the authors' opinions.

FEES:

Every service you currently see on the site is FREE.
We may change our fee policy from time to time. Changes to that Policy are effective after we provide you with at least thirty days' notice by posting the changes on this site under Benefito Fees.

ACCEPTANCE OF TERMS:

By using the website, benefito.com, you acknowledge you have read, and agree to be bound by these Terms of Use and to comply with all applicable laws and regulations. You further agree to comply with all laws, government regulations and rules regarding online conduct and acceptable content. You represent you have the legal authority to accept these Agreement on behalf of yourself or any party you represent. If you do not agree to these terms, please do not use the site.

REVISIONS:

Benefito Inc. may modify, suspend, withdraw or discontinue, temporarily or permanently, the Content of the web site, in whole or in part, at any time without notice. You agree that Benefito shall not be liable to you or to any third party for any modification, suspension, withdrawal or discontinuance of the Content. Benefito may at any time revise the User Agreement by updating this posting. By using the site, you agree to be bound by any such revisions and you agree to periodically visit this page to determine the then current User Agreement to which you are bound.

TERMINATION:

You agree that Benefito Inc., in its sole discretion, may terminate or restrict your use of services and programs provided by Benefito or access to this Site (or any part thereof) for any reason, including, without limitation, that Benefito believes you have violated or acted inconsistently with the letter or spirit of these Service, or the Agreement contained within the Site. Either you or Benefito may terminate your account at any time, for any reason, without explanation, effective upon sending email notice to the other party. In the event your access to the Service is suspended due to the breach of this Agreement, you agree that all fees then paid to Benefito by you shall be nonrefundable.
